We are in the process of buying the freehold of our property and are aware that we need to set up a company to hold the freehold. Can the FPRA provide templates for the Memorandum and Articles of Association? Also, does it have any guides for this process that it can recommend?
The FPRA responds:
Further to your email, the item referred to is the articles of association for a company – such as an enfranchisement company.
The solicitor advises that to incorporate a company for the flat owners – with the correct articles (cost circa £350 plus vat)
I am sure that the flat owners could perhaps find some template articles on the internet.
There are a number of issues relating to the suitability of the articles that may depend on the facts of the individual situation and would be happy to advise further if required.
In terms of our guide there is no template articles in the existing enfranchisement guide and it would almost be a separate topic in itself .
